Supreme Court Urged To Rein In Use Of Assignor Estoppel

The New York City Bar Association said the doctrine as currently applied ‘is overbroad and should be limited.’ Public policy favors patent challenges being brought ‘by those best suited to do so, which should generally include litigants against whom the patents are asserted, regardless of their past ownership interest in the patents,’ it said.
