The SEC Director of Enforcement gave some remarks at the New York City Bar Associations’ Compliance Institute focusing on how companies can create a culture of compliance through education, engagement and execution. Firms in regulated industries should ensure they become aware of legal developments, make applicable employees aware of the rules that might be applicable to them, and proactively executing policies necessary to maintain compliance with the law.  In a lot of areas, the path to compliance is clear; in many others, this is easier said than done in the absence of clear guidance that is supported by the law.
