A. Even if the house is not in your name you are entitled to your marital share. And if you and your husband purchased the home and paid for it during the marriage with his income or yours, it is half yours even if it was purchased in his name alone, and even if he has transferred it to his parents or to his brother. In a divorce proceeding, the court can declare that transfer void and compel him to transfer it back to himself or to the two of you jointly.
