City Bar Suggests Revision to Court of Appeals Criminal Leave Process

“ Seeking to eliminate a perception that the fate of criminal leave requests is determined by the ‘luck of the draw,’ the New York City Bar is recommending that the number of state Court of Appeals judges assigned to review each request be increased to three from one. The City Bar recommends that the full Court should hear a criminal case if at least one of the three judges assigned to review it makes that determination. In addition, it says that all seven members of the Court should be provided with synopses of all leave applications, so that all have the opportunity to voice their opinions. ”
