Earlier, the definitive guidance was the New York City Bar’s Formal Opinion 2003-04. Rule 4.4(b) did not then exist in New York (although interestingly, as the opinion itself addressed, the ABA had adopted that rule) and the City Bar concluded that there wasn’t clearly binding rule-based ethics authority in New York.
