Procedures for Addressing Residential and Commercial Foreclosure Proceedings: Memo from the Chief Administrative Judge

6.23.20 Memorandum from Chief Administrative Judge Lawrence K. Marks regarding procedures for addressing residential and commercial foreclosure proceedings. The memo provides, among other things, that actions should be commenced by NYSCEF or mail only; should contain a plaintiff attorney affirmation that the action has been reviewed and is consistent with state and federal qualifications and restrictions; and should contain a notice to defendants informing them that they may be eligible for extensions of time to respond. The memo also references and reinforces, with certain exceptions, the existing stay of foreclosure matters pursuant to relevant gubernatorial executive orders.  Read the full memo here.
