Comments on OCA’s Proposed Amendment of Rules for Electronic Filing Concerning Working Copies

SUMMARY

The Council on Judicial Administration (Hon. Carolyn E. Demarest {Ret.}, Chair), the Committee on State Courts of Superior Jurisdiction (Adrienne B. Koch, Chair) and the Committee on Litigation (Barbara Seniawski, Chair), sent a comment letters to OCA.  The comment letter supports a proposal to amend 22 NYCRR § 202.5-b(d)(4) with a few suggested modifications in order to avoid confusion.  The amendment would require notice and a five-day cure period for movants who fail to submit working copies as required by the court, something the committees applaud as a reasonable “safe harbor” provision that will promote efficiency and fairness.
