At the core of the CARES Act are multiple lending programs, and the numbers are staggering: well over $1 trillion is being made available to borrowers impacted by the financial crisis precipitated by the global pandemic. But not only are the numbers staggering, the lending programs are being rolled out at breakneck speed with the facilities designed to be exhausted within a matter weeks. What could possibly go wrong? This expert panel, including former NYSDFS Superintendent Maria Vullo, will discuss the lending programs, identify the potential litigation and regulatory risks for lenders, with a special focus on the Paycheck Protection Program and the Main Street Lending facilities, and discuss approaches to mitigate or address those risks.
