(Webcast) Elder Law for the Non-Elder Law Attorney

  • Non-elder law attorneys will become familiar with the elder law issues that may arise in their practices, whether it be a real estate attorney transferring real property of a disabled or elderly person, a personal injury or other plaintiffs’ side attorney whose client lacks capacity, or a matrimonial attorney who suspects their client has diminished capacity.

    Attendees will learn the following:

    1. How to identify and handle clients with diminished capacity
    2. What to do if your plaintiff in a litigation is incapacitated
    3. Understand different government benefits and how they could be affected by a lawsuit

    • How to identify when clients on government benefits need elder law attorney
    • Discuss different types of scenarios where non-elder law attorneys need to understand Medicaid and other government benefits with examples from practice

    Supplemental Needs Trusts (SNTs) & Long Term Care Planning 

    • Review basic legal requirements for SNTs
    • Discuss how to identify when potential clients may benefit from SNTs
    • Long Term Care planning

    7:20 pm – 7:45 pm
    How to identify and address clients with diminished capacity & What to do if your plaintiff in a litigation is incapacitated

    • Diminished capacity: review professional rule &; discuss different scenarios that may arise with non-elder law attorneys and available options for intervention
    • Discuss different types of scenarios involving a litigated guardianship that may arise with non-elder law attorneys
    • Discuss different types of guardianships: Article 81 v. 17A, standard, where and how filed
