A panel of experienced employment attorneys will discuss a range of ethical issues that arise frequently, though not exclusively, in the context of negotiating settlement in employment cases. Issues that will be addressed include:
- The duty of candor in negotiations
- Raising the possibility of criminal prosecution
- Suggesting limits on future representation
- Threatening adverse publicity
- Representing multiple parties & crafting aggregate settlements
- Confidentiality restrictions
- Settling fee obligations
