  • The program will provide an overview of significant developments in the practice of elder law. A panel of experienced practitioners will discuss the variety of legal and ethical issues raised by a multifaceted hypothetical, wherein a client seeks guardianship for a parent. The panel will present traditional as well as alternative approaches available to guardianship. Updates will be provided on Veterans Benefits, with a specific focus on Disability Pensions and Aid and Attendance programs to provide assistance to disabled and elderly clients who served as veterans. The program will also provide updates on proposed eligibility rules, and contrast them to Medicaid eligibility. The program will also cover relevant ethics issues.

    The program will feature a presentation by David Silva, Program Director of the Independent Consumer Advocacy Network (ICAN), the first statewide Ombudsman program for Medicaid recipients needing long-term care services in New York. The presentation will detail the recently-introduced Fully-Integrated Dual Advantage (FIDA) program, and will include tips on determining if FIDA is right for your client and working with FIDA plans in order to help your client get the services they need.
