Current Issues in Securitization

SUMMARY

The Structured Finance Committee (Patrick Dolan, Chair) issued a report on their July 2016 program, “Current Issues in Securitization.”  As noted in the report, structured finance is an efficient and effective financing technique that, for many years, operated in a legal environment designed for traditional corporate offerings of equity and debt; in recent years, however, the securitization area has become more regulated—which, in turn, has created both challenges and opportunities for companies that use securitization.  The program featured presentations on various securitization-related topics, including securitization in China, blockchain technology and its potential applications in the structured finance sector, mandatory arbitration, marketplace loans, and risk retention issues in collateralized loan obligations and commercial mortgage-backed securities.
