Comments of support for amendments to adopt a model pretrial order

SUMMARY

The Council on Judicial Administration, Litigation Committee and the State Courts of Superior Jurisdiction discussed the proposal to amend the Preamble to Rules 25-33 and add a new Appendix E to adopt a model pretrial order. The committees support the proposed rule change because they feel that the model pretrial order will be of assistance to judges and practitioners, who may choose to rely on the model order instead of creating their own versions.

We write to provide comments with respect to the Request for Public Comment on a proposal to amend the Rules of the Commercial Division (22 NYCRR § 202.70) by amending the Preamble to Rules 25-33 and adding a new Appendix E to adopt a model pretrial order.

The New York City Bar Association’s Council on Judicial Administration, State Courts of Superior Jurisdiction Committee, and Litigation Committee support the proposed rule change. Our committees feel that the model pretrial order will be of assistance to judges and practitioners, who may choose to rely on the model order instead of creating their own versions.
