My wife threatened to move out and take the kids

Q & A

Q. My wife threatened to move out and take the kids with her and to prevent me from ever seeing the children again. I told her that I had an affair and while it is over, she wants nothing more to do with me. She said that she will use the affair against me to keep me from seeing our two sons, ages 10 and 12.

A. Your wife cannot prevent you from seeing your children unless she has some evidence that you are an unfit father and are a danger to them. Thus while she is clearly angry with you and feels betrayed, she cannot use this to keep you from the children. Except in very extreme cases, the reason for the divorce is not relevant to issues of division of property, maintenance (formerly called alimony), child custody, visitation and child support.
