Report on amendments to the CPLR regarding disclosure of expert witness information

SUMMARY

The Committee on State Courts of Superior Jurisdiction issued a report on proposed State legislation designed to reduce the confusion and inconsistent results caused by CPLR § 3101(d)(1)’s omission of a specific time period for disclosure of expert information. The Committee agreed that imposing specific deadlines for expert disclosure will help address these issues, but recommended a number of amendments to the legislation to increase the practicality and clarity of the legislation.
