Comments on legislation which would delay the effective date of a number of the sections in the Non-Profit Revitalization Act of 2013

SUMMARY

The Committee on Nonprofit Organizations expresses support for legislation which would delay the effective date of a number of sections of the Non-Profit Revitalization Act of 2013 until March 31, 2015. Delaying the effective date would give boards of not-for-profit corporations time to adopt policies, recruit additional directors and ensure that they can adequately staff committees and have sufficient independent and unrelated party directors, and revise their governance documents. A delay would also allow more time for the Attorney General to provide guidance in implementing the Act, and for the Legislature to make corrective amendments. In addition, the report includes a number of specific recommendations to reflect properly the goals that the law espouses. The changes include revisions to address substantive issues that have arisen from the new requirements put in place by the Act and other changes of a more technical nature.
