Amicus brief filed in YU Pride Alliance, et al. v. Yeshiva University, et al. (App. Div., 1st Dept)

SUMMARY

The LGBTQ Rights Committee filed an amicus brief in the Appellate Division, First Department in YU Pride Alliance et al. v. Yeshiva University et al., a case in which Yeshiva University sought to overturn the Supreme Court’s decision recognizing YU Pride Alliance’s claims under the New York City Human Rights Law asserting gender, sexual orientation, and association discrimination against the university. The committee argued: (1) that robust anti-discrimination laws are a necessary tool for ensuring the safety and well-being of LGBTQ+ New Yorkers, especially LGBTQ+ youth; and (2) that Yeshiva University’s reading of the New York City Human Rights Law erodes the law’s necessary protections. The First Department unanimously affirmed the Supreme Court’s decision denying defendants’ motion for summary judgment, granting plaintiffs’ motion for partial summary judgment, and issuing a permanent injunction requiring Yeshiva University to recognize YU Pride Alliance as an official student organization.
