NY State Bar Association Says Illegal, ‘Racially Discriminatory’ Bar Application Question Must Be Replaced
The NYSBA report pointed to New York City Bar Association report from last June, which found that Question 26 violates New York State law by requiring disclosure of all arrests and convictions in express contradiction of the protections afforded and limitations imposed by the Family Court Act and the New York Human Rights Law. The City Bar report also said the question, as written, directly conflicts with efforts to address racial equity and inclusion in the legal profession and undermines principles of fairness.
