Peirce’s remarks followed the publication of a report by the New York City Bar Association in February that asserted that CCOs have been facing a ‘growing risk of personal liability from the day-to-day performance of the compliance function.’ The bar report recommended that, among other things, the SEC provide formal guidance regarding the standards for CCO liability.
