Lawmakers Weigh Giving Immigration Courts Article 1 Status
The American Bar Association, the Federal Bar Association and the New York City Bar Association, among others have advocated for detaching the immigration court system from the DOJ. The FBA’s proposed legislation for creating an Article 1 immigration court includes a four-to-six-year transition period, during which judges would be pulled into the new system and confirmed by the Senate if needed.
