Indigent Defense Proponents Hail ‘Historic Moment’ in NY

Among the groups in a coalition lobbying for the defense cost bill are the state Association of Counties, NYCLU, the state Defenders Association, the New York State Bar Association, the Chief Defenders Association of New York and the New York City Bar Association, Fahy said. […] Proponents say that by adopting a county-based approach to compliance with Gideon beginning in 1965, the state committed an error that continues to plague the indigent system. In some counties, they argue, services are adequate, while in others, where funding has lagged, public criminal defense is woefully underfunded and, sometimes, violates the constitutional rights of defendants.
