In connection with a different topic that has frequently troubled New York lawyers, this article will consider the extent to which lawyers may ever charge nonrefundable legal fees in light of a new opinion from the New York City Bar Association, Formal Opinion 2015-2, which gives guidance on the permissibility of nonrefundable fee arrangements when the fee arrangement is a flat or fixed fee.
