City Bar Defines Rules for ‘Local Counsel’

The New York City Bar Association has issued an opinion defining the professional obligations of lawyers acting as “local counsel.” Local counsel should, but are not required to, enter into a separate written agreement with the client that discloses the scope of the representation, the opinion said. While New York City attorneys may enter into agreements that circumscribe their obligations, “being designated as ‘local counsel’ does not narrow their ethical obligations” under New York Rules of Professional Conduct, the opinion asserts.
