NYC Bar Says Local Counsel Can’t Shirk Ethics Rules

Attorneys who act as local counsel are subject to the same ethical rules as all other lawyers and must clearly define the extent of their representation to clients, the New York City Bar Association‘s Committee on Professional Ethics said on Tuesday in a formal ethics opinion. The committee said that although lawyers have traditionally used “local counsel” to describe an attorney who offers help on a matter in his or her jurisdiction when the attorney primarily responsible for the matter practices in another jurisdiction, the New York rules do not distinguish between different categories of lawyers.
