Employment law has made broad use of mediation — sometimes with arbitration as a back-up — for disputes involving discrimination; termination; failure to hire or promote; harassment, and non-compliance with wage and hour provisions under the Fair Labor Standards Act. Employment contracts in New York frequently provide for ADR at the employer's expense, generally in exchange for giving up the right to litigate.
