  • The presentation will review three recent New York State Court decisions regarding interpretations of the NYC Zoning Resolution.  These decisions highlight various aspects of merging zoning lots to create a combined zoning lot, and the respective rights between the different owners of the tax lots.  The presentation will include an overview of the zoning regulations governing NYC.

    The legal issue before the Courts was whether a combined zoning lot is permitted to include partial tax lots or must incorporate the full tax lot.

    The legal issue before the Courts was the rights of parties in interest to the tax lots that are part of a combined zoning lot, and whether they have waived their right to approve an expansion of the combined zoning lot to include additional lots.

    The legal issue before the Courts was whether an amenity (rooftop garden) must be accessible to the residents of every building on a combined zoning lot to satisfy residential open space requirements.

    Review of NYC Dept. of Buildings draft memo requiring that combined zoning lots must include the full tax lot and not just a portion of any tax lot, when creating a combined zoning lot, as well as the documents required when forming a zoning lot.
