(Webcast) Preventing & Addressing Sexual Harassment Post-Cuomo

  • This CLE program will analyze the lessons to be learned from the Attorney General’s investigation into allegations of Governor Andrew Cuomo’s sexual harassment. Using the investigation as a focal point, with an eye towards prevention, this CLE will illuminate the significance of several key takeaways, including analyzing (i) the power of the first-person narrative in articulating a claim of sexual harassment; (ii) how power imbalances impact a victim’s willingness to come forward; (iii) the role of bystanders, witnesses and/or aiders and abettors and what impacts their willingness to come forward; (iv) the protections or lack thereof for victims and witnesses; and (v) the importance of making credibility determinations in sexual harassment cases.

    The CLE will use these takeaways to contemplate legislative and other reforms, particularly with respect to the prevention of workplace sexual harassment and the impact of confidentiality in settlement agreements for sexual harassment disputes.
