Litigants involved in cross-border disputes must often navigate treacherous “onshore” and “offshore” jurisdictional terrain, and they expect their lawyers to understand the interplay between the two and to plot the best course. Join us to learn more about the challenges associated with the interplay of “onshore” and “offshore” jurisdictions and about strategies for sailing through them in one piece. The program will be led by Kobre & Kim lawyers Tim Prudhoe, a commercial litigator who represents companies and high-net-worth individuals based in the US and the Caribbean, and Jef Klazen, a New York-based litigator who focuses on the enforcement of judgments and arbitration awards and other cross-border asset recovery issues.
The discussion will explore key factors that cross-border litigants should consider, including:
- Navigating “blocking statutes”—laws that are designed to nullify discovery requests from US courts that target non-US citizens;
- Tips on how to successfully enforce US discovery orders in offshore jurisdictions;
- Information on potential cross-border discovery tools;
- Strategies for obtaining injunctive relief in offshore jurisdictions; and
- Enforcement of offshore judgments in the US and vice versa.
