This program will provide practitioners with resources to assist them in representing clients with animal-related issues in housing. Topics to be discussed include New York City, State, and Federal laws and regulations regarding landlord/tenant rights and obligations. Panel members will cover topics including lease provisions, litigating animal nuisance cases and the three-month rule, and emotional support/service animal reasonable accommodation claims.

6:05 – 6:40 p.m. Landlord’s Attorney Perspective Speaker will discuss leading cases involving animal issues in multiple dwellings and condominiums/co-ops, and will discuss the implications of Parkchester which resulted in the split between the 1st and 2nd Departments in application of NYC’s pet law. Speaker will also provide examples on how to draft a model “pet policy” for co-op or condo boards.

6:40 – 7:15 p.m. Tenant’s Attorney Perspective Speaker will discuss the N.Y.C. Pet Law, the six month statute of limitations, and reasonable accommodation requests for emotional support animals, and service animals in housing.

7:15 – 7:50 p.m. Government’s Perspective Speaker will discuss filing a complaint with a government human rights agency when a landlord, co-op board, or condo board refuses to provide a reasonable accommodation permitting the tenant to keep her/his emotional support animal or service animal.

This program provides 2.0 credits in skills for the New York & New Jersey MCLE requirements. California & Pennsylvania credit differs as it is based on a 60-minute credit hour.
