Climate Mobilization Act: Financing and Offsetting the New Emissions Limitations Requirements

  • The 2019 Climate Mobilization Act (Local Laws 92, 94, 95, 96 and 97) establishes aggressive greenhouse gas emissions caps for NYC buildings that exceed 25,000 gross square feet. The caps go into effect in 2024, and become more stringent every 5 years. Both commercial and residential buildings will be impacted. This CLE will explain the new compliance obligations, identify upcoming deadlines and provide guidance on commercial lease provisions and strategies for co-ops and condominiums. An experienced, multi-disciplinary panel will distinguish the CMA from other local law requirements on energy use and reporting and explain how to pursue adjustments and offsets to emissions requirements. The panel will discuss design/engineering considerations and reveal how owners can obtain financing for compliance through the property assessed clean energy (PACE) program.
