  • Discover how attorneys are using social media sites (Twitter, Facebook, MySpace, Google+, and LinkedIn) for discovery, trial preparation, direct examination, cross-examination, background checks, and locating missing persons and learn how to get profiles admitted into evidence. Don’t be left behind in exploiting this gold mine of information. Also, find out about potential social media ethical traps and how to avoid them with a review of New York’s (and the ABA, as well as other states’) social media guidelines, ethics rules, ethics opinions, and court opinions. You will receive social media research instruction and ethics tips from recognized Internet research authorities – Carole Levitt, Esq. and Mark Rosch, co-authors of the book, The Cybersleuth’s Guide to the Internet (IFL Press, 2015) and 7 ABA books.

    Special Bonus: All attendees will receive The Cybersleuth’s Guide to the Internet (IFL Press 2015) as part of this seminar. This book features a fifty-five page chapter dedicated solely to conducting social media research and summaries of 15 social media ethics opinions and many court opinions.

    • obtain useful background information about parties, lawyers, judges, experts, and current & potential clients
    • find information to attack a party or witness’ credibility
    • uncover fraud
    • seek out the smoking gun
    • Overcome social media discovery and authentication issues
    • Introduce social media profiles into evidence

    Avoid potential social media ethical traps by:

    • being careful about who you friend
    • finding out whether “friending” can ever be construed as deceptive, a misrepresentation, or an ex parte communication
    • learning when you can use information from social media for investigative purposes
    • discovering why you should monitor a juror’s social media posts before, during, and after trial
    • finding out about lawyers and judges who faced social media ethics violations
    • correctly advising clients about “cleansing” their profiles
    • configuring security/privacy settings in your profile and more!
