Ethics hotlines play a vital role in aiding lawyers to navigate evolving professional conduct obligations. Yet unlike lawyer assistance programs and referral services, these hotlines lack statutory confidentiality and civil immunity protections, discouraging usage—even among well-intentioned attorneys.
The City Bar has proposed legislation that would extend explicit confidentiality safeguards to hotline communications, grant civil immunity to volunteers and sponsoring bar associations, and limit waiver of confidentiality to the inquiring lawyer alone. This creates a secure environment where candid, ethics-based questions can be addressed without hesitation. Permit Nonresident Attorneys to Practice in New York Without Maintaining a Physical Office in State
The City Bar supports the repeal of Judiciary Law § 470, which requires nonresident attorneys to maintain a physical office in New York. This outdated requirement imposes unnecessary costs on attorneys and clients, does not enhance regulation or service of process, and is incompatible with modern legal practice. Repeal would lower costs, expand access to legal services, and promote justice.
