Report in support of the Expanding Proven Financing for American Employers Act

SUMMARY

The Structured Finance Committee (Patrick Dolan, Chair) submitted a comment letter to Hon. Paul Ryan, Speaker of the U.S. House of Representatives, in support of H.R. 4166, the Expanding Proven Financing for American Employers Act. The Act would add a new Section 15G(e)(7) to the Securities Exchange Act of 1934 that would provide an alternate risk retention requirement for any collateralized loan obligation (CLO) if that CLO satisfies the definition of a “qualified collateralized loan obligation.”  The Committee supports H.R. 4166 because it provides a workable regime that would permit small and mid-sized companies to preserve critically important access to the multi-billion dollar pool of capital provided by CLOs.
