Comments on the Unified Court System’s Commercial Division Advisory Council’s proposal to amend the Standard Form Confidentiality Order

SUMMARY

The Council on Judicial Administration (Steven Kayman, Chair), State Courts of Superior Jurisdiction Committee (Adrienne Koch, Chair), Litigation Committee (Cary Samowitz, Chair), and Communications and Media Law Committee (Charles Sims, Chair) submitted comments in response to the Unified Court System’s Commercial Division Advisory Council’s proposal to amend the Standard Form Confidentiality Order (SFO). The SFO has become an “established staple” in Commercial Division practice since its release in 2007. The Committees agreed that the time has come to revise and update the SFO in light of the growth of electronic filings and other court practice developments and suggested certain modifications to the proposal, particularly with respect to sealing of documents and the impact of third-party subpoenas.
