Amicus Brief: Petition of unconstitutionality before the Constitutional Court of Colombia against Articles 64, 66, and 68 (partial) of Law 1098 (2006) and against Article 1 of Law 54 (1990) (regarding adoption rights for same-sex couples) (Spanish)

SUMMARY

The Inter-American Affairs Committee and the Vance Center for International Justice submitted a brief to the Constitutional Court of Colombia addressing the unconstitutionality of certain Articles of Law relating to adoption rights for same-sex couples. The brief, submitted in Spanish, summarized court cases in the United States that have dealt with the rights of same-sex couples concerning their fitness as parents. The brief demonstrated that courts have very closely scrutinized all of the evidence and expert testimony supporting the arguments for and against same-sex couples having the right to build families, including the right to adopt children, and found there is no justification for denying same-sex couples the same rights to adopt and raise children as opposite-sex couples.
