Yates Assesses Effects of ‘Yates Memo’

The Yates Memo, issued in September 2015, told prosecutors to focus on holding individuals accountable for corporate wrongdoing, and it said companies have to provide “all relevant facts” on culpable individuals to receive cooperation credit when settling cases. The memo brought cascades of criticism from the defense bar, and Ms. Yates said in her speech at a white-collar crime conference hosted by the New York City Bar Association that the reality is far different than the one presented by lawyers in client alerts.
