State expands cost-saving construction practice, giving hope it will be used elsewhere

However, only a handful of state agencies are currently allowed to use design-build. For everyone else, the law states that designs must be completed before an agency can bid out the construction work. For years, the city and advocates have been unable to persuade Albany to expand design-build’s reach. And they were disappointed that only the governing bodies of the Javits Center and Penn Station were brought into the fold this year. ‘[Design-build] benefits should be available to public owners across the state rather than restricted to two state-level entities,’ the New York City Bar Association wrote in March.
