Social Media and Jury Trials: Where Do We Stand?

Social media research of potential and empaneled jurors is an area of the law that is constantly evolving. A succession of ethical opinions and trial court decisions have answered some questions and raised new ones….The New York City Bar Association‘s Committee on Professional Ethics also suggests that pretrial social media research may be obligatory. The authors suspect that the standard of good practice in New York may someday require attorneys to perform some form of research of prospective jurors.
