New Law Relating to HIV Testing

HIV testing procedures will be updated this fall after the Governor signed legislation that revises informed consent requirements associated with HIV/AIDS testing. Under the new law (A.11487/S.8227), HIV related testing will be offered to every individual between the ages of 13 and 64 (or younger or older if there is evidence of risk activity) receiving certain health services. Patients may now give oral consent to a HIV/AIDS test that has been ordered as a rapid test and written consent will be included on general consent forms. Individuals receiving an HIV/AIDS test will be provided counseling for either a positive or negative test result, with the counseling tailored to the outcome of the test. The new law goes into effect September 1st.
