The panel will look at the effects of Obergefell and Windsor on employment law. Specifically, does the decision have any effect on claims under the FMLA, Title VII, or any other federal anti-discrimination law? How do Obergefell and Windsor change employers’ responsibilities with respect to benefits? Is there tension between the Hobby Lobby decision, and Obergefell and Windsor?
The panel will also include a historical perspective of NYS Human Rights Law, including the Division’s position requiring equal benefits prior to marriage equality and discussion on the tension between Section 296(11) of the HRL and the provisions preventing employment discrimination based on various protections.
