This program will provide an overview of significant developments in the practice of elder law. Experienced practitioners will discuss the viability of assisted living residences such as nursing home alternatives and the available types of assisted living options including profit, non-profit, and SSI/Medicaid funded facilities and programs. An update on the implementation of mandatory MLTC for duals in NY will be provided, including new policies regarding internal appeals, aid continuing, assessment in nursing homes, spousal impoverishment, and mandatory nursing home enrollment. A preview of the FIDA demonstration beginning in the fall will also be provided. The new Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act will be covered with a particular focus on suggested language regarding jurisdiction that can be included in guardianship petitions.

6:05 p.m. – 7:00 p.m. Long Term Care Planning for Clients using Assisted Living Options
Are Assisted Living Residences becoming a viable nursing home alternative? Learn about the available types of assisted living options including profit, non-profit, and SSI/Medicaid funded facilities and programs. This presentation will review the Assisted Living Reform Act of 2004 , the NYS Department of Health’s Regulations for enriched housing and Assisted Living residences (ALR’s) and the NYS Department of Social Service’s Rules for Adult Home (ALF’s) which together comprise the current licensing and operation of the variety of assisted living residences and facilities in NYC. Sample contracts will be reviewed and outlined including the variety of pricing structure for both the room and board, hospitality and services offered to residents. Resident rights and obligations under the law and the contract will be addressed.Judith D. Grimaldi
