This Supreme Court has been especially active on the First Amendment, taking cases ranging from campaign finance to animal snuff films to violent video games to offensive funeral protests. The panel will discuss the Court’s First Amendment jurisprudence and approach and the constitutional philosophy of the most active Justices, including what can be expected from the two newest Justices, Kagan and Sotomayor.
