The prosecution of lawyers for acts of advocacy raises important policy issues – not least, the concern that they can have a chilling effect on the cherished ideal of zealous advocacy. Should these kinds of prosecutions be governed by special and formalized rules? Should judicial supervision be required? What ethical limitations, if any, govern the prosecutor's decision to investigate and prosecute a lawyer?
