New York State Legislature Seeks to Overturn ‘Daimler’

The New York City Bar Association, which filed a report last month in opposition to the legislation, argued that the proposed legislation implicates the due-process doctrine of “unconstitutional conditions,” pursuant to which the government may not require a person to give up a constitutional right “in exchange for a discretionary benefit conferred by the government where the benefit sought has little or no relationship to the property.”
